If I get a job during my grace period after my OPT is over, what happens? If my company agrees to apply for my H1 visa, will I be able to work during the grace period or after I receive H1? Just curious :)

I remember reading about this somewhere but unfortunately I can't find the source right now. Anyway, if I remember it correctly, since you are on grace period your OPT doesn't get automatically extended meaning you cannot start working for the company until the start date of your H-1. If the H1B petition was filed while you were on OPT, it would have been automatically extended and you would be able to continuing working until a decision on your H-1B application was made. . I don't have a source for this info. So take this info with a grain of salt. Edit: If it's a cap exempt company then you will be able to start working as
soon as your h1 application is approved. For other companies you won't
be able to start until Oct 1st

For profit company H1b effective Oct 2010. Non-Profit are exepmt so you can start your H1b anytime you want If your opt expires before Oct, you cannot work until H1b is effective. However if you talk to some lawyers they can put an appeal for the time you were not employed during OPT if you qualify for it . Hope this helps... Peace

Thanks Sabkosathi and Baire for your inputs..Sabkosathi what you said makes lot of sense... Baire it will probably be a non-profit organization but even for that they will probably need to sponsor my H1 while I am still on my OPT. But if they agree to sponsor my H1 during my grace period then I think I need to wait till I get my H1 to start working......
