All, Has anyone gone through RIR Labor Certification process? Is there anyone who can give some info on this? My company applied Labor Cert through RIR a year ago (before PERM came out). I have not heard anything. Any idea please...

yeah this sucks man. and looks like the retrogression isn't going away... so i am thinking about looking for a new job and start an EB2, which is still current. has anyone tried this? or is anyone here on sajha a potential employer looking to hire a great programmer? :-p send me an email by clicking on my name here and i'll send you my resume :-) seriously!

All the labor certifications that was filed before the implementation of PERM is shipped into two backlog elimination center. One is based in Dallas and one is in Philly. Both centers are issuing 45 days letter to ask the employer if or not they wanted to continue their cases. You need to be more careful and talk to your employer about if or not the 45 days letter being received. If the 45 days letter fails to respond, then the case is considered to be closed, and it takes another year just to re-open your case. There are cases being in backlog center from 2001. The more cases are said to be of 245(i), where the Clinton Administration gave amnesty to the Illegals. This has created a huge problem for the State Workforce Agencies to process the case in timely manner, thus the goverment stated centralizing all the cases and BECs are working to finish their data entry and certifying the cases, but their working is said to be not taking place as it was said earlier. The problem with these two BECs is not strickly following the FIFO. One may still find their case of 2001 sitting around the conrner, while other may find their 2004 cases getting approved. Few people who are approaching their 6 year limit on their H1B visas should consult their respective attornies to send email to those centers for the screen shot, that will get the 7th year extension.

Dear MJ: I remember, once, someone comparing Labor Certification with Labor Pain. I truly believe on that statement. I think, applying Green Card via skilled worker catagory is really a painful situation unless you are applying as an outstanding personel in your respective fields, on which case you are completely exempt from LC. I think, PERM is better than RIR. I just a have quick question to you. Did you receive a letter from the Dept of Labor (depending on which state did you file your petition), stating that your letter has arrived in a backlog processing center and do you want to continue the application? If yes, then you have to reply that letter ASAP prior deadline. And after that, again waiting, waiting, waiting.... By the way, you mentioned of your application of just being a year old, so I think, there is nothing we can do on this situation, but to wait and see. However, you can apply again via PERM; it does not hurt your prior application. Hope it helps, or else you can knock on your lawyer khopadi (if you have hired) once in a while. You know how the lawyers are... Good luck ! HD
