Hi guys ,i need your suggestion pls.I have been working in a store ,i haven been paid for 7weeks and when i ask them they said wait tomorrow,tomorrow. And now its been almost 1 and half month.

Actually it was some were around $4000 and they gave me $1000 last week and now almost $3000 remaining.

As i have EAD but I am working on cash.What should I Do??

It really sucks man how u trust someone and be loyal to their business but when it comes to money,everything changes.

record the conversation with hidden device like phone where they admit they owe you that much money. after that you can threaten them with a lawsuit or actually sue them. you can perfectly work on cash, as long as you intend to pay tax at the end of the year.

thankyou so much for your comment ,as everything is recorded in a system and i also have all the papers with me that says i have this much amount left.

So what should be the better option??Its not a problem if you work in cash right,i tried to work in cheque they we will do but they dont take it seriously.

Find another job and quit, you don't have to give any notice. You can quit anytime without penalty since you don't have contract. Text your boss asking for your remainder of salary he owes.He will delay, possibly. By law, your employer is supposed to pay you immediately (except regular payroll date) when you quit job. Wait 30 days. File a case with department of labor against your employer. When you file case, ask for overtime till date. Suppose, you worked 60 hours a week for 1 year and you only got paid regular, claim 20 hrs overtime a week for one year. Also, claim meal break. Here is a breakdown of what u get awarded by labor judge:
1. Your pay owed by your boss
2. If your salary was 100 a day, penalty of $100x30 days = $3000
3. Penalty of around $600-$1000 (not sure exactly how much)
4. Meal break pay for as long as u worked for that guy
5. Overtime pay for as long as you worked for that guy

At times, we tend to think you only want your pay, but these assholes need to be taught a lesson so they dont do this to someone else who is less informed.

I got awarded around $5000, when my boss only owed me $1000 and I didnt claim meal break or any overtime as I voluntarily didn't claim any of those.

And before you File..do this....

Write a Formal Letter (obviously print it in a plain White Paper) and give it to them..e.g template below:

NOTICE OF CEASE and DESIST:

Mr. Patel

You have failed to provide me with my salary compensation on my repeated verbal and written requests. This is the final warning notice to provide my remuneration for my work to your business.

(ali milayera ..timi lai kati claim garna maan cha..tyo sabai yaha mathi rakha...)

and print your name at the bottom...
ani print garera pathai deu...je parla parla..tini haru le timi lai pani taile pani ta cash maa illegally kaam garis bhanera bhanla...but that will not be a big issue for you...not withholding Federal Taxes when paying employees are penalized offenses to the Employer first.

I would recommend to send through legal counsel. You could make arrangement to pay off after getting payment from them as well.

There are couples of free legal services in the areas and can get consultation with them and send the letter through them. It will make case much stronger for you. 

In other word, you could write letter in the aforementioned format suggested by other members, contact to the department of labor and process through them.
