Hello guys, I need your opinion on my case. I have pending asylum application in court. I have also applied for TPS. I got my EAD through asylum and am working. My company is willing to apply GC for me. I cannot apply for H1B because I no longer meet H1B criteria as I am in pending asylum status. What should my company do? Can my company even apply for my GC? I have heard that company can apply for GC directly without having to go through H1B procedure. Any suggestions will be very helpful.

Your case looks complicated to me. What is you status now? Pending Asylum isn't any status. If your company is willing to file for GC, you need to be in status. May I know what kind of job or position your company is willing to file GC? I have a friend in similar situation.

asylumandtps...while you are in TPS.. your company can file for greencard as TPS allows you to adjust status. i would say if you are maintaing f1 status and haven't used asylum EAD or TPS EAd then you should be able to apply for H1B. so pending asylum case waiting for court date don't qualify for H1B ???? or is it because, there is no f1/opt status. what about those who are waiting for their interview dates... are they qualified to file h1b.??? I think using asylum EAD would void your OPT.
