I have about 4 months OPT left (ends in the first week of Jan. 2011). Fiscal year 2011 starts from October 1, 2010 and there are still lots of H1B quotas left ( more than 30,000) for 2011. If I get a job/sponsor, will I be able to apply for H1B after October 1, 2010 (after the fiscal year starts). Will the remaining H1B quotas be automatically canceled after the fiscal year 2011 starts? I did not find any definite answer regarding this. Any information regarding this will be highly appreciated (source of information if possible) I need information as early as possible because a company has offered me a job starting Oct/Nov but they don't want to apply for H1B before I start the job. The company knows my opt expires in 4 months and I will need visa sponsorship after that. I need the information before I decide to move. Thanks in advance

you won't be able to apply for the h1b after october for this year. you're gonna have to wait till april of next year to apply again. Any leftover quotas for this year will automatically terminate after october 1.

The H-1B Quota remains open until filled, i.e. until March 31, 2011. Your prospective employer can file a H-1B petition till then, The October 1st is merely the start date of employment on H-1B. About termination of the remaining H-1B quota visas; if left any, will be terminated only on April 1, 2011 when H-1B Quota FY2012 starts with 65000 H-1B Regular Visas and 20000 Masters Quotas. Yes I think that you can apply until March 31st until quota is filled.In earlier years due to Indian consultancies the quote used to fill hte same day so we were not used to these rule. Also you can file before you graduate.In my case I was graduating in May.I filed in April and later USCIS send REF for my certificate which I later sent and got approval.Hope that helps.

I think its still open and will be open untill Dec 2010..That is what happened last year below is the link for H1B CAP Count.

BengalTiger, I had applied my h1b after october last year and i know some people had applied even in december.It is up to USCIS if they want to terminate remaining H1b quotas after october 1st,However, at this bad economy,i believe they wouldnot do so.You can surely apply for h1b and you should continue your job without any worries. I hardly write in sajha but i couldnot resist myself seeing your inquiry.If you want to get an instant result you might want to do premium processing as i did.I got result in 3 days. Hope this helps. Thanks for your input everyone. I have decided to join the company from October 1, 2010. The company said they would process the H1B once I start working for them. I hope H1B becomes available until the end of the year.

Hi guys, Do not wait till March 31st to apply for H1b. If the quota is not fulfilled does not mean that it is open till March 31st. It's the USCIS decision to allow H1b filing if quota is available. Generally USCIS decides till when it will be receiving H1b applications. Thanks

Even though I got my h1 on Dec 18th, that time I heard H1B was closed by Dec 21st. So brtguy is right, if u want it, do it ASAP.
