Hey guys, I need your expertise to filing this year's tax. Its been 2 yrs I am here in US and filing tax as a resident, though I was in F1 status. I even worked using my SSN to work offcampus and used W2 of that work while filing tax. Now I am in H1B and want to file tax legally, as an international. Is it okey to file 1040 NR after filing 1040 for two year? What might be its consequences? Your suggestions are highly appreciated.Thanks in advance

Thanks blue_moon,They have TIN.You can apply for your dependent's TIN when you file for Federal return.I do not know the procedure though coz one of the Nepali daai did it for me last year. I am told that upto $19000 will be non taxable for me if I go for Standard deduction coz I have 2 dependents.I am not sure how it works if I go for itemized deduction. I am still seeking more information in tax deduction. Any information is highly appreciated. Thanks

Hello Blue moon, You can get ITIN number for your dependent from any of IRS office. You have to fill W-7 form. You can do it your self also. Otherwise if you wanna get more refund go to one of indian CPR and pay around 60-100 bucks then they will do everything, i mean filing for ITIN number also. How you are filing your tax return? 1040 or 1040NR ?

Does anybody have any idea about F-1 studnets can file 1040 or not? If they file 1040, can get more refund, if file through 1040NR then get less refund. Does anybody have any detail idea about it? I heard, though you are an international student, after certain time you will be considered as RESIDENT only for tax purpose and you can file 1040. Filing through 1040 will affect for GREEN card processing or not?

Gorkhali jetho HEre is What is written in IRS website Nonresident aliens. Generally, if you are a nonresident alien (other than a resident of Canada or Mexico, or certain residents of India or Korea), you can qualify for only one personal exemption for yourself. You cannot claim exemptions for a spouse or dependents. I am going to file 1040 NR. I heard that it should be five years to fill as Resident.

let me get clear here: Standard deduction for a married filing jointly : $10000 Tax credit for we three(me and my dependent) : $9900(3300*3) Total = $19900 Apart from those deductions,what else can I include?

yes, you CAN file as married-filing-jointly and claim 3 exemptions. Also, don't forget to claim the phone tax credit. If you have paid for college expenses for any of your dependents, you can also claim the Hope credit.
