Dear Secretary Rice:


We are writing out of concern for the deepening political crisis in Nepal. The actions taken by King Gyanendra since February 1, 2005, represent a drastic setback to the cause of democracy and require us to review our assistance for Nepal.

We appreciate the Department?s statements calling for the immediate restoration of multi-party democracy and the protection of human rights. Such statements ? along with those made by the United Nations, the governments of India, the United Kingdom, and other countries, and a wide range of international non-governmental organizations ? make the world community?s rejection of the February 1 action abundantly clear. But words do not appear to have altered the situation on the ground.

Since February 1, King Gyanendra has suspended civil liberties, including freedom of the press and right of assembly; placed Nepal?s last elected prime minister, the leader of the largest political party, and dozens of other political leaders under detention; cut off telephone and Internet communication; and given virtually unfettered power to security forces whose human rights record was already described by the State Department as ?poor.?

The proclamation by which the monarch assumed unilateral control sets no limit on the period of monarchical rule, stating merely that the King?s new ministers ?will give utmost priority to reactivating multiparty democracy in the country within three years.? It is our understanding that the Constitution of Nepal, which has explicit provisions governing the monarch?s ability to declare a State of Emergency, provides no legal basis for the King?s extreme action.

Nepal faces many challenges, including widespread poverty, a growing Maoist insurgency, a highly troubling human rights situation, and weak political institutions. The King?s action will make these challenges more difficult. It will embolden the Maoists (who have long criticized the monarchy as anti-democratic), derail the possibility of peace talks, further weaken and alienate the political parties, and divert the Army?s attention from fighting the insurgency to controlling politicians and journalists.

We believe that the best hope for reversing the King?s misguided decision and setting Nepal firmly on a course of strengthening democracy and ending the conflict is through coordinated, constructive pressure from the international community. We are hopeful that King Gyanendra can be persuaded that ruling by decree is not an effective way to solve Nepal?s problems.

To this end, we urge you to propose the formation of a contact group including India, the United States, the United Kingdom, the United Nations, and other concerned countries, represented by a special envoy to negotiate a resolution among the constitutional forces in Kathmandu. The envoy could seek broad support within Nepal for the establishment of a new multi-party government with new party representatives, the restoration of constitutional rights, and political and economic reforms aimed to undercut the Maoists? agenda ? reforms which are long overdue.

In the interim, we urge you to declare the immediate suspension of any obligation or delivery of FY 2004 and FY 2005 aid to the Nepalese Army. This would reinforce similar moves made in recent days by the governments of India and the United Kingdom. The Administration?s request for $4 million in Foreign Military Financing for FY 2006 ? more than double the FY 2005 level? comes at a particularly inopportune time, and could be misinterpreted in Kathmandu as a sign of approval for the palace?s anti-democratic moves. Congressional support for this assistance will depend on the King?s progress in restoring democracy and the rights and freedoms guaranteed by the Constitution of Nepal.

Whether or not the actions of February 1 automatically trigger Section 508 of the Foreign Operations Act, the King?s actions are clearly at odds with the intent of the law and with the goals outlined by President Bush in his inaugural address:


?it is the policy of the United States to seek and support the growth of democratic movements and institutions in every nation and culture. . . We will encourage reform in other governments by making clear that success in our relations will require the decent treatment of their own people.?

We agree, and we encourage you to ensure that these words are backed up by strong, effective action.

After 1996 there is no Democracy in Nepal since maoists started war. In remote villages there is no democracy at all after 1996.

3 missing students found dead


KOL Report

KATHMANDU, Feb 16 - Three students missing after clashes between the security forces and the Maoists in Morang have been confirmed dead.

The three had been missing since Sunday, Feb. 13. The Jaaite Secondary School, to which the students belonged, confirmed their deaths on Wednesday.

The students had gone to bathe in the nearby Toli Khola to prepare for the Saraswati puja that day.

Four others students who were celebrating Saraswati puja within the school premises also sustained injuries.

The incident has not been confirmed by the Army. On Tuesday, the Army said that 10 Maoists and three security personnel had been killed during that particular incident in Morang.

Meanwhile, a policeman and a Maoist were killed in separate incidents in Jumla and Mugu on Wednesday. (yv)

Peace is more important than democracy...with out peace there is no chance for democracy

Kali G, with out law and order, there can be no freedom for the masses, Nepal never had a true democracy...they had anarchy...is that what you want to subject your fellow men to return to ...murder and thievery....

If it is then democracies chances in Nepal are truly dead....

Why are people in DC going nuts.... why do you want to participate in this rally....

We take US and India as largest democratic country... but even people in US and India supported Patriot Act and TADA/POTA Act respectively to fight terrorism and bring peace to country...


Ok for time being lets assume your rally was well heard by Bush government and it forces gyanendra to go one step back or does economic sanction....

Now what do we gain...

1) let us say king goes one step behind... then again those political jackals will come to power and start snatching our flesh selll it .. they will become rich their living standard will increase ... but poor nepalese will still suffer and die ... and those jackals they have already showed that they will not be able to bring peace with maoist......

2) let us say economic sanction in done... who will suffer poor nepalese ofcourse king will be compeled to increase tax and take more money out of poor nepalese people to support country budget.. .then country will again head to grievious civil war.....turn into somalia or ethopia...

So guys in DC think before you participate in this rally.... do analysis of whom you are helping with participating in this rally....

To bring change in nepal we have always thought a change in system is required.. and king has provided us that... so why not to support him... he is asking just 3 years time .. so let us give him a chance... what other option do we have.....

We take US and India as largest democratic country... but even people in US and India supported Patriot Act and TADA/POTA Act respectively to fight terrorism and bring peace to country...

Lastly, being a citizen of country with fake democracy we should support king and give him chance to lead country to good governance and peace....

Please do not participate in the rally, do not confuse more already confused international community......

the protest rally should be against the human right activists.........what could they do when when the maoists were kidnapping and killing so many ppl?.....what were these ppl doing when there were so many nepal bandhs? when all the ppl in nepal pray that they get back home safely before they leave their houses......what about that? the right to walk freely....the right to go to work or school without having the fear of being kidnapped.........i right to say " i'm not giving my hard earned money for ur stupid cause"..... the rights for peace.....i think these are the rights all nepalis want right now more than any other rights.

The protesters in the US are doing everything they can and everyone should suppor them.

To support the protest event I like to request help from all nepalese in the US in what ever way they possibly can. Students are specialy encouraged.

** I request people to bring winter tires of your cars (which you'll no longer need after this winter) for the TIRE BURNING event during the protest program.

** Students studying in universities and colleges across the region are especially encourged to participate at the event. Please bring at least a bag pack full of pieces of brick and rocks for the DHUNGA MUDA event in case a clash with riot police is to take place.

** Nepalese who own SUVs or trucks or vans are requested to bring huge rocks and boulders at the event for the CHAKKA JAAM event during the protest.

** Owners of SUVs and trucks as well as Nepalese working at gas stations are requested to donate gas for the Gyanendra ko PUTLAA JALUNEE event during the protest.

** Nepalese working at clothing stores like GAP and JC PENNY or BANANA REPUBLIC etc are requested to bring overstocked clothing from the stores they are working to prepare MASSAL for the MASSAL JULUS at the protest program.

If you really care about Nepal, I dare you to organize a protest rally against corrupt politicians, who are the root cause of the current situation in Nepal. I dare you to speak up against the maoist barbarities. As I write this, we are on day-4 of the indefinite nationwide blockade imposed by maoists. It's us -- the nepalis actually living here in Nepal -- who are at the receiving end of the maoist atrocities. The maoists have also declared that they will close down ALL private educational institutions, both schools and colleges, in Nepal begining from the next academic session -- putting in jeopardy the future of hundreds of thousands of students across the nation. Why aren't you guys doing anything about that?

If not, let the King do his job. He is the ONLY beacon of hope for a lot of nepalis like myself.
