whatever you do, your name, dob, your record in i-94, remains the same! think twice before filing for asylum. if you get it you stay. you don't you get deported.

As far as i understand, Once you filed for the asylum and gets rejected, it provides a sense to the USCIS that your intention was to stay in US which is against their law. . No matter what status you are in now B1B2 or F1 or H1,you will get the decision letter from USCIS stating that you have to leave the country within specified time period. It won't tell you to revert back to your previous status just because of you are in F1 or H1. I have seen people with H1 and F1 filed for asylum and both got approved. I have also seen a best friend of mine who went to nepal right after he got the deportation letter. He is fortunately coming back because his wife is going to be US citizen in the state. I recommend you to talk to the immigration lawyer. Be careful in choosing the lawyer because lawyer tends to provoke you to apply simply because they thing everything is possible. Good luck to you.

yes, you can file from any state..even u can go to CA and file for Asylum..their is no problem.. but just don't file right aways of your arrival on CA.. stay for a some time... make a perfect story.. gather all the documents you would need... just make sure that u have every possible set of documents for which your story is based on.. As far as i know.. u can file for Asylum from NYC and BOS as well, but the choice is yours. As u might be thinking that from CA the success rate is High.. Go for it, their is no problem. if everythings went fine then u would be all set by 60 days of your filing for it.. If u don't want to hear any -ve side of filing it then, just be positive and go for it.. and i'm not sure but i think that u can still save your F1 status if u didn't get approved. Once you file for Asylum, thier is no looking back dude.. you can fight till the end.. even if u r unapproved u can go to court and fight for your right.. and the chance for approvel in court is high.. but it would take some time for your case trail. So, in that phase of time u wil get Work permit.. u can work and make some money to finance your case..and you do not need to take any advice from us once you r in this game you will get all the ideas by your own..
