Hey all,

Does an asylee need a visa to go to India? My cousin is thinking about going to Nepal through India. He's a businessman from Rautahat and his dad got killed by Maoists when he refused to give donations to Maoists.

My cousin was studying in the US then and decided to seek asylum and got approved.

So how does it work? Does he need a visa to go to India? He is thinking about using his Citizenship at the Indian Airport and then flying into Nepal.

Please note that he isn't a business man. His father was a businessman.

Also, he doesn't have a Green Card yet. He does have a valid Travel document.

JPEG, so if your cousin's dad died, and he got his asylum application approved, he won't have any more reasons to return back to his motherland?

You can’t fly into India without a valid passport from any country besides Nepal. If you have a valid passport you can go to India without a visa and take train or bus to Nepal even if you are a refugee in the US.

You don't need a visa to travel India, but coming back from India (which you must do, I believe) to US you need papers to re-enter USA. I don't suggest you to go to India or Nepal without proper document i.e. Greencard in your case, otherwise Indians give you hard time at the airport.

Actually, It isn't for me Bisal.

It's for my cousin. He does have a valid travel document issued to asylees and any other permanent residents who might or might not have a green card. Coming back to the US won't be a problem, but I'm not sure about whether they will let him in after he lands in India or not. Appreciate your comments though bro.

The US doesn't impose any restriction on his travel to any country. But his visit to Nepal might prove otherwise for his refugee status.  He can visit India and sneak into Nepal without any stamp or official documentation.  Being a Nepali citizen, he should not have any problem visiting India. And he should be able to come back to US using travel document.


Beware, Indians do like to give Nepali a hard time, it is in their blood, carry some $cash$.

Hello Quaqmire,


If you have a travel document issued by american govt & if your asylee story was approved based on Nepal's story, than you need to get Indian visa and travel to India first & enter Nepal. There's no problem entering India by american travel document.


Pls. note that visa to India might take 1 to 3 months. If you need urgent visa to India, you need to write application mentioning your urgency.

Quagmire, Here is what I think your cousin should do:


Get the Visa to India.  Nepali passport holder don't need visa to travel India but since your cousin with asylum status won't have a Nepali passport it is safe to get Indian Visa.  It cost $73 and can avoid him a lot of confusion and problem.  Below is the link for Indian Visa.  Also beware that unlike Nepal, India doesn’t have any immigration office at the airport to grant him Visa.

Second, I strongly suggest not flying to Nepal as with flight there is a risk of record.  Take a bus or Train. 


I'm not a Lawyer but this is what one of my friend who was on the same boat as your cousin did.

झमेला बेहोर्नु परेको पीडितहरू बताउँछन्। गत जनवरीमा तीर्थयात्रा गर्न
भारत भ्रमणमा निस्केका कान्ति राईसहित दस/आठ घन्टा मुम्बई अध्यागमनमा
रोकिए । हङकङ फर्काउन तम्तयार अध्यागमनका कर्मचारीलाई हारगुहार गरेपछि
छाडिएको कान्तिले बताइन्। ‘नेपालबाट सधैं त्यसै उड्ने गरेकी चाहिँदैन होला
भन्ने लाग्यो, उता पुगेपछि निकै तनाव झेल्नुपर्‍यो ।’ उनले दुखेसो
सुनाउँदै भनिन् । व्यवसायका क्रममा पटकैपिच्छे यात्रा गर्ने कृष्णराज
पाण्डेसमेत सधैं भिसा लिएरै उड्ने गरेको बताउँछन् । ‘भिसा लिनुनपर्ने थाहा
हुँदाहुँदै पनि लिन बाध्य छौ ,’ उनले भने, ‘उतापुगेर किन झमेला मोल्नु ।’

विमानस्थल अध्यागमनको दोधारे नीतिका कारण पनि हङकङेली समस्यामा छन्् ।

जिज्ञासामा उनले हङकङ र चीनमा रहेका नेपाली राहदानीवाहकले भारत भ्रमणमा
भिसा लिनैपर्ने


बताए । नेपाली राहदानीलाई भिसा नचाहिनुपर्ने होइन र ?
प्रश्नमा उनले भने ? ‘नेपालबाट होला यहाँबाट चाहिन्छ, नलिँदा मर्कामा परे
हामी जिम्मेवार हुँदैनौं ।’


यहाँस्थित नेपाली महावाणिज्य दूतावासका वाणिज्यदूत
सुशीलकुमार लम्साल आफूसमेत अन्यौलमा रहेको बताउँछन्् । ‘सन्् १९५० को
इन्डो नेपाल ट्रीटीअनुसार नेपाली भएको प्रमाण पुर्‍याउनेले जुनसुकै देशबाट
बिनाभिसा भारतमा यात्रा गर्न सक्छ,’ उनले भने, ‘नेपालीका गुनासा सुनिन
थालेपछि हामीले यस्तो प्रावधान हटाउन बारम्बार महावाणिज्य दूतावाससमक्ष
कुरा राखेका हौं, उनीहरू यात्रुकै सुरक्षा र सुविधाका लागि यसो गरिएको
भन्दै पन्छिन्छन्् ।’
