Ok I have few question for H1b... I finished my undergrad and that time i applied for H1b, for some reason it got denied and i went back to school but continue with my job. Its been almost 3 yrs, i have been working with where i am not, and they never asked me about the status. Now, i finished my master and I this time i have applied from Agency, my questions are
- Am I in trouble that i have been working for 3 yrs paying all taxes ?
- I had my opt and someone told me that if USCIS approved to new status, now they wont look your past records than they had the recent records of your unless otherwise you are involved in any crime or fradulent activities. Is this true ?
- During the period, i was out of status coz of injury and i did re-instated my i-20, will that be problem if I wanted to go back to nepal once my H1b approved?
- My opt is valid till November 2007, and currently i am working with the previous company, not the one i have applied with, so will this be problem?

1.Working and Paying taxes without being authorised to work : NO PROBLEM
2.Applying for New H1-b although previously denied (unless you have criminal records): NO PROBLEM
3.Being out of status due to injury no problem as long as you went back to school. And you have medical reports saying you were injured.Actually i belieeve if you were injured (having medical reports )and did not goto school..you were not out of status: NO PROBLEM
4.OPT Being Valid till Nov 2007. This is your PROBLEM.....
you are already OUT OF STATUS.

Be Positive and optimistic, do not loose hope, here is the truth. A guy got USIS's notification of out of status and time to deport. That person graduate and applied for OPT and got it. Now he is a US citizen.
Be optimistic, your work will not bar unless you are really unlucky. You will be fine. Build up confidence.

In your fourth question, you said that your OPT is valid till Nov 2007. Do you mean to say that its valid till Nov 2008? And you mistakenly wrote NOv 2007. If that is the you are fine.

that was Nov 2008, just a typo but was a huge mistake.

and again there is one college in Woodbridge VA which will issue the CPT, if anyone wants to know more about that college, please you can post it here, my friend went to that college and he is in OPT right now, i will be glad to help out fellow Nepalese Student.
