 green card processing under EB3!!

Hi Everyone,

Just wondering how long it will take us (nepalese) to a get a green card processed if we file it under EB3.

I have heard / read something that goes like... "all green card applications are current" (not sure what exactly it means though).

I would really appreciate if any of you who know about it could share the total approx time it takes for a green card application to be processed and completed for EB3 (Undergraduates).

Any other info regarding this will help me a lot.

It may take around 3 months to get labor, but you have to put ad on paper. Then depends upon availability of cota, you process will be forwarded. Better get advice from lawyer.

Where are you? depends upon your lawyer and Compnay. They may charge you $35,00 to $5000. But, first, your employer must agree to do this process.

My employer has agreed to go on with this process. I am in MD. And really, I also want to know how LONG does this whole process take now that the EB-3 is current.

One more information,
Unconfirmed sources indicate that the State Department allocated the EB visa numbers for the FY 2007 "conservatively" with the expectation that the USCIS and USDOL would remove backlogs in a fairly rapid pace. Accordingly, at the end of May 2007, reportedly they allocated only 50% of the total annual quota for the EB numbers. Now, since it is not anticipated that the USCIS will produce enmasse I-485 approvals taking out a large number of the EB visa numbers, the State Department was afraid that unless the FY 2007 quota would be used before the end of September 2007, some of the visa numbers would be wasted. From such judgment, the State Department had to open the EB visa numbers current in July so that no EB visa numbers for the FY 2007 would be wasted. Anyway, it turned out to be a good gift for large number of EB immigrants. We thank the State Department for making a timely and right decision.

What is EB-3 Employment based immigrant visa?

The EB-3 employment visa is an immigrant visa which allows foreign nationals who are skilled workers, professionals or other type of workers to enter into the U.S. to obtain permanent residency.
What are the various categories under the EB-3 visa?

The various categories under the EB-3 Employment based immigrant visa are:

EB-3(A): This category is for ‘professional workers’ with a U.S. bachelor's or foreign equivalent degree and with a job offer from a U.S. company

EB-3(B): This category is for ‘skilled workers’ for positions that require at least two years of training or experience and with a job offer from a U.S. company

EB-3(C): This category is for ‘unskilled workers’ for positions that require less than two years training or experience and with a job offer from a U.S. company
What is the definition of ‘professional worker’ for EB-3 Employment based immigrant visa?

To be eligible as a “Professional” you must be a qualified foreign national holding at least a U.S. baccalaureate degree or a foreign equivalent degree and be a member of the professions.
What is the definition of ‘skilled worker’ for EB-3 Employment based immigrant visa?

To be eligible as a ‘Skilled worker’, you must be a foreign national capable of performing skilled labor which:

• Requires at least two years of training or experience

• Is not of a temporary or seasonal nature

• Does not have appropriately qualified workers available in the U.S.

Expected Time line:
Labor: 3 months. I knew someone who got approved in 2 days, and also I knew someone who got approved in 5 and half months. Normally it will be approved in 3 months.

I-140(Premium): Got approved in 4 days. Normal time is 2-3 months without premium.

I-485: Knew someone who got GC in 3 months after I-140 approved. Got workpermit in 3 weeks after I-140 approval.

This is for EB2. But since EB3 is also current, I believe it should be similar.

Hey guys,
How do I look for a lawyer? I need to find a good, but not that expensive, lawyer to process my documents for EB GC.

I am located in MD. Any laywers that you guys recommend? Any help would be appreciated.

There are plenty of lawyers around MD. Go to any indian store and grab free indian papers. There should be advertisemntes of these lawyers.

Are you sure this is true? what's the current Processing date of EB3? Somebody told me it was July 2005.

My Priority date is Sep 2006.I guess it was filed from Chicago. I already got my Labour and I40 approved. I am desparately waiting to file my 485. Sick of working with Dhoti Company.

Could somebody tell me the current date of 485 for EB3?

xgaffadi, did u send ur work exp from ur previous employer when u filed for 140. I was in some desi company and they are not giving me that letter. so I have decided to use letter from my coworke .anybody here in sajha with similar kind of exp.

As on now both EB2 and EB3 are current and processing time would be same for both. But there are rumors that EB3 may soon be backlogged at least for 6 months – 1 year. There are chances that Nepal may remain current but you never know. We are talking about USCIS here :(

For now, here is the most realistic timeline.
Fastest Realistic
Labor preparation 2 months 3 months
Labor approval 15 days 1 month
I-140 (if premium) 7 days 15 days
I-140 (if regular) 3 months 6 months
I-485 3 months 8 months
Time lost in between the processes - 2 months

I-140 and I-1485 can be filed concurrently but I think its better to get the 1-140 approved through premium processing by paying additional $1000 and then file I-1485 with approved I-140. The fastest possible time you can get your green card is 6 months but the realistic time to expect is about 14-15 months assuming that you will not get stuck in the FBI name check during I-485 processing. If you get stuck in name check add 1 more years to the processing time. Good Luck :-)

It was a combination, since I worked for different companies. I used a letter from my co-worker for one company, and for the rest I used company letter.
I also submitted Graduate Assistant experience letter, which I got from my university.

As of now...EB2, EB3 are current.

Just want to add that the letter from co-worker should be notarized by the co-worker.
