My past employer still owes me some money. Its been 5 months that they have not paid my money in full. They have paid my salary but they have not paid my bonus amount. Because of many negative reasons I have left this company also.

In shortcut, the client has given some bonus amount to all contractors ( around 2200). client has paid the bonus amount to vendor and vendor has paid to my past employer. Every time when I ask about the bonus amount they make some reason. Most of the time they told me that vendor has not cleared the amount. Later, I talked with the vendor. Vendor told me that they have paid all the amount. Currently my past employer said they have issued a check for the remaining balance which I never got. They are just making reasons and reasons and reasons. And now, they are not taking my phone calls and they are not replying back any of my email. Its been a week that they are ignoring my phone calls. I need your suggestion. What should I do next? They owe me around 1200.

I don't want any other people to go through the same situation as me. So I am exposing the name of the employer. The name of the company is Vaptech Inc. Currently they have changed their name to SPG America. I DO NOT recommend anyone to this company. Stay a way from this company. Their office is in Piscataway, New Jersey.

Labor department is your only solution. Complain there.

Dhotis are always miss - treating Nepalese.... but the blame is on us. Dhoti haru le kahile chodne bhane na Nepali haru lai...... Nepal ma bhako bhaye Gorkhali hunthiyo... work as a human shield for Dhoti grovernment...... US ma aayo: school padhda - dhoti ko gas-station, dhoti ko motel and dhoti ko restaurant............ school sakepachi dhoti ko consultancy or dhoti manager...... mujo U2 ko geet yaad aaudai cha.......... We can't live with or without Dhotis..... bro go and talk to the Boss nicely and threaten him that you will use lawyer and sue him in federal court (use political words thou)...... Americans are very strict in issues like labor rights ....they will not leave this Dhoti alone..

Bonus is technically discretion of employer, you can't really demand it just because client paid it. You worked on W2 and they paid all your salary , they are done. May be on the basis of morality they should pass on something. But you can't really force them on bonus.

But if you choose to threaten them with DOL hype, they might pay you because either they don't understand what DOL does, or don't want to get in radar.

They will give you all the detail what you need to do further. labor fraud is a huge crime, they will definiely get in trouble.
And before doing that, make sure you have rights to the bonus paid by employer. Sometime, consultancies make you sign contract saying you will be paid $xxxx flat. That means they will not pay you anything else.
