Let's discuss about the TPS extension that is expected to happen today (till the end of day). The following notes should be considered:
1. Federal register schedule of publication notices: 8:45 AM, 11:15 AM and 4:15 PM ET. (not published yet)
2. The sites that need to be followed: https://www.uscis.gov/ https://www.federalregister.gov/ http://immigration-law.com/
3. If TPS is not extended by DHS, it will be extended at least 6 months counting from Dec 24, 2016 for smooth termination so that people can reinstate their original immigration status.
4. If TPS is extended, the EAD will be automatically extended up to 6 months and can be used to work with the same expired EAD but needs to apply for new within this period.
5. I will also discuss about required documents for re-registering TPS later in this thread, if it is extended.
Please let me know if you need any information about this. I will share whatever I know. I have been working/following/discussing/conferencing on this issues for few months.

What do you think applies for my case? - TPS and EAD both approved before , currently only on TPS status In I-765, "I am applying for" will be "renewal of my permission..." right? Eligibility Category : c (1) (9) current status : TEMPORARY PROTECTED STATUS. Those are some items I am getting confused on. Feedback will be appreciated.

sms22 , yes that is true. If you meet the the Eb1 , eb2 , eb3 yes you can apply for EB(employer based ) categories. That said , I hear that by law you cannot change status from TPS to GC -- They will send you for consular processing to the EMBASSY. Which means your GC can be approved but from the embassy back home. However , if you have a F1 to go along the F1 your can change status from F1 to GC. The reason I said by law is that recently a Judge ruled that you are able to change status from TPS ..so with that ruling you can use a lawyer and appeal to change the status. google it. Consular processing is not a bad deal either UNLESS , you have overstayed your visa or remained illegal in the country for 180 days or more. Federal law bans anyone who have stayed illegal for that amount of time up to 3 years.

"That said , I hear that by law you cannot change status from TPS to GC" That's not true. You can change your status from TPS to GC or TPS to H1 as long as you a willing employer to sponsor for H1 or GC. It might be handled on a Case-by-Case basis where few applications will not be approved for conversion from TPS to GC or TPS to H1 but you dont have to go back for Consular Processing. @fdpower, do you have an example where someone had to go out of the country for Consular Processing?

Is the person still eligible for TPS if he or she has been out of status for a while, and if he or she didn't register the first time ?. Any information will be helpful. Thank you
