As seen in many recent cases where people of color have been victims of excessive use of force by police, this is not about race but the inclination of police to use excessive force.
Police in a northern Alabama city severely injured a 57-year-old Indian citizen after slamming him to the ground, leaving him temporarily paralyzed, according to the man’s lawyer.
“He was just out for a walk, and apparently someone made a suspicious person call … This is a grandfather who came to help his son and daughter-in-law with their 17-month-old son who was premature and developmentally delayed,” Henry F. Sherrod, a civil rights attorney from Florence, Alabama, told Al Jazeera on Tuesday.
Sureshbhai Patel, a permanent resident of the U.S., arrived in the U.S. only one week before the incident occurred. His son Chirag Patel, an engineer, flew him from the small Indian town of Pij to live with them in Huntsville, a suburban town next to Madison, according to Sherrod, who described the neighborhood as affluent.
While he was out for a walk in his new neighborhood on Friday morning, Patel was stopped by two Madison police officers who said they were responding to a suspicious person call.
When the officers began to question him, Patel said “no English” and “India” as he tried to point to his son’s house and repeated the house number. Sherrod said Patel was walking on the sidewalk and not acting suspiciously.
Unable to communicate with Patel, the officers began patting him down before they claimed the man put his hands in his pockets and “slammed him to the ground,” Sherrod said.
The attack left Patel bleeding from the face, paralyzed and in need of surgery to fuse two vertebrae, local news website AL.com reported. He remains hospitalized.
“I think it was because he looked brown,” Sherrod said, adding that the two police officers involved were white. Only one of the two policemen was responsible for the injuries, he added.
Madison police on Monday issued a statement saying that the officer responsible for Patel’s injuries had been suspended and that they were investigating his use of force, according to AL.com.
The family has decided file suit for damages including Patel’s medical bills — which will likely be in excess of $100,000 dollars even if he makes a full recovery, according to Sherrod, who met with the family on Tuesday.
Sherrod, who visited Patel at the hospital Tuesday, said Patel had regained movement of his arms, but was not yet able to grip with his hands. Patel also regained limited use of his left leg, but his right remained paralyzed, Sherrod said.
In addition to damages, the family is suing to obtain audio and video evidence taken by the police officers during the incident. It had not been released to the public because the Madison police department said the recordings were evidence in the ongoing investigation.
Sherrod criticized the incident as evidence that use of force by police is an issue that extends beyond people who are poor or African-American. “It can happen to anyone,” he said. “It just takes a little bit of a miscommunication and the officer thinks violence is the solution,” Sherrod said.

sojoketo If you don't have a simple decency to keep the conversation civil, you probably shouldn't be commenting. People are arguing here but they have some logic to their arguments. Your use of language shows your intellect level and frankly I have no interest in having a discussion with you.
That kind of language might be acceptable at your house, not everywhere. If you have refutal to the logics being made, why don't you point it? Grow up. In your defense, what could one expect from a person whose last post was, "PENIS-Less Divorceguy." I am not addressing any of your point.

I am not saying that law enforcement does not have the right to defend themselves in dangerous situations. They certainly do. And they serve and operate under very stressful conditions and often times than not go above and beyond the call of duty. I do appreciate and admire men and women in uniform. One for the troops!
Now,
All I am saying - and reading the article above - I do not see the law enforcement officers having a reason to pat this guy down let alone arrest him with extreme prejudice and break his back.
Lets try and look at the facts - The guy was walking down a street, maybe peering into open garages - someone thought this suspicious and reported this. Police arrive, there is a communication barrier.
Now, why does the officer now want to pat the guy down? Because he put his hand in his pocket? Because he made a sudden movement? He threatened the officer in any way? What is the probable cause here?
The officer tries to pat grandpa and he recoils - maybe is just a reflex action, maybe he is afraid - remember communication barrier?
Ok, now assume that grandpa has a huge dick and a hard-on and the officer thinks its a gun and is in "fear for his life". I assume the officer is bigger than grandpa (57 year old Indian FOB), is there a need to slam him so hard to the ground such that the guy gets a broken back? Does that not seem as excessive force? And unjustified?
In my opinion the 14th amendment is designed for such a scenario, the law enforcement officer has to demonstrate reasonable probable cause to search, detain or arrest anyone - including grandpas.
The question is, what will happen now - I think the officer will be back at his job after a reasonable amount of time, grandpa and family will get money from their lawsuit which will come in handy to pay medical bills and lawyer fees. And grandpa will go back to India with a very negative feeling of US police.
What should be done to change this? Call out the police when they act in this manner. Civil rights did not just happen in a vacuum. Nor did American revolution happen in a vacuum. It's not only our right but duty to speak truth to power and call things out as it is.
I agree to a certain point to your argument that the son should have warned the father about interaction with the police - but then he likely warned about interaction with potential hoodlums and not police.
This thing has hit home so close to me is because that could easily have been my father than some random Indian dude. My father would get bored sitting at home while we were at work and would go for a walk around town. I did not warn him about the police, never thought that I would have to.
And we should acknowledge that an injustice has occurred here and maybe the blame of the incident lies more on the law enforcement side than a guy not knowing English.

Kundale, yeah I can see that point. Basically, I am not defending the cops, I am just saying it's not as clear cut as we want it to be.
Despite all the boasting of check and balance between judiciary-legal-executive committee, I have to say that the most of the situation unfairly favors the law enforcement, i.e. the police department. Often time the burden of proof lies over the innocent who should've been treated innocent until proven guilty. I think the advent of cell phone camera could address this inequality issue to certain extent - this is a great tool in public's arsenal. This is why many police departments want to impose a law to ban the use of cell phone camera in these cases. I am hoping for a federal mandate to allow the use of cell phone camera in public places - including in transactions where cops are involved. Until then, I am going to exercise prudence and advise my near ones to do the same.

This is what you will do: Based on your all posts, you will not tell your dad to not to make sudden movement and simply keep on blaming Cops that they are assholes, they need to know your dad is no danger to them or anyone. Should such encounter happen to your dad, you dad does not know what to do since you haven't made him aware of what to do and so will try to reach in pocket to take phone or phone number to tell cops to call you. Cops will think he is trying to get the gun and they will slam your dad. At the end of the day, your father gets hurt, then you will sue the Cops coz it's their fault , go to Court and get loads of money in lawsuit. You were and you will be wright, that's Cops fault and they are to blame and so you get loads of money. However, your father is hurt.
This is what I will do: I will say to my dad, "In an encounter with Cops, do not do anything, keep hands outside without moving them, just yield to them. Say No English, My Son. They will pat you down themselves and they will find whatever phone number or phone or any written address in your pocket and they will call me." In such encounter, my father does everything I told, does not get hurt, the Cops will call me and ask me about my father. I will describe them everything. At the end of the day, my father is safe and sound.
In your world, you are right, that's Cop's fault. But your father gets hurt. In my world, I am right, I don't care about Cops, I care about my father. My father does not get hurt. Who loves one's father more?

Regarding the language i speak at home, it is a very simple nepali lanague which is not decorated by diplomatic phrases unlike the diplomats of sajha users only to show off their freaking attitude to prove themselves how correct they are even when they are favoring the culprit.

That video is definitely so disturbing, it does not even look like he was going for his pocket, his hands were already behind. Just based on the news I had thought the slamming gone wrong, but nope, this is definitely bad tactics. These cops should definitely go to Prison.

Yep. Doesn't look like he was going for the pocket. This is why I say cell phone camera is the check and balance we need.
Now I know some over here will say how come we change our tune. What we said was solely based on the article; video evidence so far refutes the article. In my play by play above, act 2 is violated- doesn't look like the cop had enough probable cause to slam the old man to the ground. Disgusting.

The problem with people thesedays is that they are so ready to give up their freedom and their rights, and believe the police is right without giving a benefit of doubt. Even in the eyes of the law you are innocent until proven guilty. There have been numerous cases of rogue cops so the ignoramus pundits of sajha should reserve their final judgment till they see all evidence, and show some compassion to the needless victims.
An important question arises = Why is there a need to slam any suspect to the ground when they could easily be handcuffed without such use of force?

This is painful to watch and worse than what I thought transpired. The Indian guy did in no way act in a threatening manner to warrant that kind of take down. On top of that no matter what the son had told his father about interacting with police would not have prevented this.
It is very important that things like this get called out. Sometimes things are more than merely an academic discussion.
I hope the guy who called 911 also realizes that he has some part in bringing this down. When the human thing would likely have been to just go and ask the person if he was lost or to try and begin a conversation - you know, like normal people would do - instead of calling the police and following them around the neighborhood in their trucks.
For all the opulence and strength and high living standard that exists this is a very fearful society.
