Kinda Urgent! Cannot find source (e.g., federal registrar) that says EAD auto extended to 2025 (which was my assumption). Apparently, its just TPS (which I have applied and is still pending). I am being asked to furnish proof of EAD extension which I cannot find. Call for help to immigration gurus.

Is this then the correct answer? i.e. our EADs cannot be extended at least at the moment? if so, what happens to those who have updated i-9 with June 2024 as the expiry date?

Yes 100%., you can call USCIS I9 contact center 888-897-7781. With the expiration date 2019/2020/2021 cannot reach the date beyond June 30, 2024 even with the 540 days auto extension. Whoever wrote/drafted the FRN didn't realize this problem will occur for the people with auto extended work permit. In FRN the language is very clear, if you file EAD in timely manner, if you don't receive it by certain date you will get 180 days to 540 days extension from the expiration date printed on the face of the card. They didn't mention anything about auto extended card. So let's hope for updated FRN with auto extension before June 30, 2024.

It's not our fault USCIS is blacked up and cannot process the EAD in timely manner ie with in 90 days that's is standard time frame but we will suffer this time if they didn't approve the EAD or didn't publish the auto extended FRN before June 30, 2024. There are few options for Employer, legally they can terminate you because of the lack of document to prove you can legally work in United States or they can put you in Unpaid LOA for few weeks to month, that's your employer decision.

It will get extended, technically you don't have to re-register tps right now, you can wait until June 24, 2025.

@apunge Let me tell you the secret of E-verify system. You can input anything, any value and any information and save and submit. It is the company's responsibility to verify the information before entered in the E-verify. Only company get it trouble if there is an INS/ICE audit otherwise they will be fine.

No, you have to re register it before june 2025. Before they extended till june 24 and added one more year extension to 2025. Dont know why they did that . If you re register it now, you will get a new tps notice of action that ends in june 2025.

It's not e-verify that needs to be checked for continued employment re. I9 update is what needed. I got educated by the company lawyers yesterday. E-verify is at the start of the job.

@apunge- i really feel bad for your situation. My company accepted my i-797 notice for EAD and applied the automatic extension date. Read this : https://www.uscis.gov/i-9-central/employee-rights-and-resources/employee-rights I feel like your employer is discriminating you even though you have the correct documentation to prove your are verified to work and fall under the auto extension rule. you may try the following: If you feel your employer did not hire you, treated you differently during the hiring or Form I-9 process, or terminated you because of your national origin, or immigration or citizenship status, call IER at 800-255-7688 (Worker Hotline) or 800-237-2515 (TTY), or visit IER’s website.

Thanks nash24. I m not being discriminated. This is one of the best, of not the best, of the FAANG and therefore are very well staffed to understand the letter of the law. And looks like they are correct unfortunately. Hopefully USCIS corrects their mistake

Hopefully they will extend the EAD with updated FRN. 540 or 180 days does not apply to the EAD which was expired in 2019/2020/2021 and auto extended till June 30, 2024. You can call USCIS I9 contact center 888-897-7781, for exact information.

You can also download employer handbook from USCIS, which clearly states that 180 or 540 days extension from the date printed on the face of the card.

Yes, they don't E-verify for current employees. For I-9 recertification they need unexpired EAD/ EAD which can be extended through Temporary Final rule or EAD which is extended through Federal Notice.
