What or Why is the 'Congresswomen situation' occurred that you have mentioned in your processing? And what were the rfes that took things so long for you? It seems like your wait was almost 2 years since 140/485 filing.

We had to reach out to congresswomen to reach out to USCIS on our behalf because I-140 was pending for a very long time and USCIS provided only generic response even after two service requests. Alternative was to go for an Infopass, but the first infopass is not too different from a typical service request.

Re: RFE: This is an NIW case with my wife as the primary applicant, but I-140 processing time is not different for NIW (also no option to pay to expedite NIW-EB2). The RFE was subjective. The summary language was "your research has been cited as background information and not as the foundation for further research." Additional testimonials from multiple scholars who cited her work as the foundation of their work were needed. For that, over 75 papers who cited her work were to be reviewed and she had to find which of them have cited her work as the foundation of their work and not just background. Some 25 papers were shortlisted, out of which about 10 were strong. लेख्ने मान्छे पाउन गाह्रो भयो, बल्ल बल्ल लेटर लेख्ने मान्छेले धेरै समय लगाए, त्यहि हो.

Thanks nepals! There are others (including Nepalese I know) who had to wait even longer, both PERM and NIW routes. It sucks, but happens sometimes.

I140 and I485 concurrent
I140 approved : 2/23/17
EAD and AP approved : 2/16/2017
I 485: PENDING

I saw a case of EB1B case approved for Jan from TSC. Few EB2s from middle of december are approved recently. So my assumption is , they are processing around mid-december . All these cases I saw were non-concurrent ( i-140 approved before i-485 filing). So I believe it gonna take at least another month before they start touching EB3 for jan. Eb2 should be in couple of weeks. And add another month for concurrent filing ( non-premium). In some blogs, they saying EB3 are few months behind EB2 , but don't know how true is that.

I485 rd date? Concurrent or non concurrent? Eb2 or eb3?

Mine is rd nov 16, 2016, eb2, non-concurrent and still waiting. Getting Tired of checking status everyday.

Thatangryguy: was it non-concurrent? I have seen through trackkit that concurrent sometimes have chance of getting approved much earlier.

@Mancini, that was concurrent though. I thought non-concurrent gets approved before the concurrent usually . Concurrent is faster than the combined time frame of I-140 and I-485, thats what I thought. But you seem right, in some cases , they getting approved faster.

A non concurrent EB3 @NSC got approved recently with RD Sep 2016. So you should still be close as you are EB2.
