Subject: Immigration Issues about students returning from Nepal-
For those of you student who are returning from Nepal has to face immigration questions in the port of entry to USA. It is suggested to answer the questions related work during their stay in USA, AFTER TALKING TO THEIR ATTORNEY only, if you had worked using SS#. If you answered as "No, I didn't work, they will check using your SS#, and ultimately will make return you back to your home country. Recently 2 students send back to Nepal from Chicago airport. Moreover, it may be good idea not to go back home until you got H1 visa, if you had worked using your SS# in USA.

i am returning from nepal this saturday!!! and i have worked using social security number and filed tax too but it was 2 yrs ago!!!! will i have any problem? what am i supposed to say if i get caught>?

FYI, 2 students from Dallas were also sent back for almost the same reason. Now, please don't ask for the source here again. I had known both of them. Be careful guys. Just a suggestion

I know a guy who was sent back from chicago. Would be better if you can avoid chicago as POE. Since CollegeFootballRocks said, Dallas sounds strict too.
There was a thread about a student busted in chicago for same reason and he filed asylum rt there. Don't know anything more about that.
Anyone who knows this kind of incident, please mention the name of POE so that other can avoid those cities duriing their entry.

True, this has happened to 2 guys i know, recently while entering from the port of virginia and dallas. Not every body is deported, if they have used there social. However, some are returned back home, a friend of my from dallas was returned because he had used social and homeland said he didn't notify school before returing Nepal. When asked if you have used social be careful how u answer the questions. This is so wrong, all we want to do is work so tat we can' pay for expensive colleges, and if any brainless idiot wants to know sources add my fren in facebook, don't have his cell number from back home. Its not the best time to return home, they are jus lookin for reasons to send people back.

It is sad for those two guys but it will eventually work out for everyone. I hope that they will be honest to other potential students in Nepal so they won't come. They themselves are saved from being a slave of dhotis but they don't realize right now. Others in Nepal will be scared to come to us in std visa thus be safe from being in their shoes and not be dhoti slaves in the name of future which is not even there with all tjhe h1b crap. Good for them they will do well in Nepal.

I am not tryin to scare any body but we have struggled hard, since, the day we came here. Even though we are not legally able to work here but we have few other options. Again the punishment is very harsh considering a minor crime, which is working to meet our expenses. Homeland security can just deny you entry if you have been found working on social. I suggest u to take caution if u have worked on social. Not every body has been caught or will be caught but don't take a chance if u have lot to lose or else u'll be a topic of discussion. Trust me no one can really help you out except you yourself. If you do get denied entry at the point of entry, don't hesitate to file asylum.

it's not easy to file asylum at the poe. first they will detain you and put you in a cage for months. second judge is not a dumb to think you filed that after being in the usa for years in f1 and returning back and not being able to get it. most probably you will be put in a cage for months and finally sent back, your approval chances are slim to none..

Very Interesting.However the problem, as everyone is aware is that IRS does not share any of it's information with USCIS (although not always this is true).

Which means that IRS would not have information in it's database to claim that someone was involved in unauthorized work using SSN or for what employer you worked for or how much money you made. You possibly have worked in your college using your SSN, which is perfectly permissible.
What my assumption is there is more to the story, rather than being their work history checked using SSN, which I highly highly doubt. If you have taken a semester or two off without following process, have taken excessively long time to complete a degree, have taken reduced course load more often than permitted or something in your history that shows you are not serious at all with your education this would probably put a red flag on your record. Owing to these circumstances (which is again my assumption), the USCIS can(?) possibly request your tax records with IRS (?) or may be not, I am not sure.
Someone I personally know, was denied Visa, after the person had stayed several years in States (abt 9-10 years), cause somewhere in long long past had dropped a semester...it was in the record, they asked for explanation and then denied the Visa...
Personally I had to leave States, cause I got into work violation. My records in the USCIS database shows that I was involved in unathorized employment. I followed the process, left States, had a good education history, got another scholarship and was back....at POE it does show in the system, however they don't know the details to it, as I had it explain it to them.
Another thing, Chicago as POE IS strict with my experience. I travelled several times through Chicago and everytime it has been pain in the ass..when I fly through Indy, things seems much relaxed.

I strongly suggest to have MSP as POE.
Aba officer cool pareko ho ki thah bhayena..tara didn't took me a minute there.
Just one question asked," Do you have $$ with you"?
I said No.
