Govinda Raj Joshi acquitted on technicality

KATHMANDU, Nov 16 - The Special Court on Thursday gave a clean chit to former minister and Nepali Congress leader Govinda Raj Joshi, who had been charged with corruption.
The Commission for Investigation of the Abuse of Authority (CIAA) had filed a graft case against Joshi accusing him of amassing property worth over Rs 39.3 million through illegal means.

SC members Bhupadhwaj Adhikari, Komal Nath Sharma and Cholendra Shumsher Rana in their ruling said that the case filed against Joshi did not even draw the attention of the court to enter the "facts" to make a verdict.

The clean chit issued by the SC stated: CIAA filed the case against Joshi as per the Prevention of Corruption Act 2059, following the dissolution of the House of Representatives, which does not have a "specified time limit" provision. According to the Prevention of Corruption Act 2048, a case must be filed within one year of the initiation of action. The petition was quashed since Joshi's case did not fall within the timeframe stipulated by the Act, and at the time when Prevention of Corruption Control Act 2059 was in effect, Joshi was not holding any government post, hence, he was acquitted of all the charges filed against him, even without entering the "facts".

The CIAA had filed a case against Joshi seeking a 13-year imprisonment, seizure of all illegal property and a penalty equal to the property he had amassed.

It’s so sad our justice system in Nepal is so corrupted. Appeal court’s verdict ( I would rather call decision) is influenced by the current political developments that being political parties getting empowered and these criminals still have hold on their respective parties. It’s is very obvious that party’s leadership wants to protect these criminals for the sake of solidifying their positions and keep it. Debilitating leaders like Girija, Madhav, Deuba etc are in need of support of such criminals and gangmembers to hold their position. Due to influence of such leaders, judges are not able to deliver fair verdict. This may also be job security if not kick backs. Unfortunately, democracy is enjoying by these leaders not by the people.
It'svery sad our justice system is so corrupted.

Our justice system is corrupt... to some degree... I do not have proof but it is a common perception.

But more than that:

Our justice system is incompetent... to a large degree... and there is ample proof... this being the shining example.

The easiest thing for everybody is to complain. When young Nepalese go aboard they forget their home land, they do not like the culture, people. Everything looks different to them. For them everything is wrong. After all they are enjoying foreign soil . Political system, justice system and any system . It is easier said then done. if you really think every system is bad then why don’t you go back to your country and do some thing good or keep quite and keep making dollar. Remember you are from third world country. know who your are and what direction your heading for.

No Proof is needed.
You just look at their amassed property ( beautiful house within some ropanies, bank balance and investment in industries).
These guys have a close link with royals. Of course, they are very close to government also.
Its not a surprising matter.

Why corrupt people, especially those in leadership positions, engage in adultery?

Not that others do not involve in adultery, but I think the inclination is higher for corrupted people, especially for those in leadership positions.

One of the most corrupted leaders in the pack, Govinda made a semi-successful attempt(both to his pleasure and dismay) to cross the waal of a woman's house. Hence, got his name s "parkhaal mantri."

I was shocked with the news. These monkeys hmmm.... i should think worse then that lets say the results of defective condoms.... are too much. How the hell they got clean chit. tero ghushya ko 2046 bhanda aagadi ko sampati kati thyo sabi ta cha... clean chit deney ra liney lie dubai lie KARBAI garnu parcha... Hey SPA and maoist KARBAE gar na.. I think we should do another ANDOLAN.. to kick out all this BUDA

WELCOME TO THE NEW NEPAL....

Even though we all know what Khadka and Joshi did...they are clean in terms of baised Supreme Court, and the heavily politicized Court Systems of Nepal ! What a disgrace....Dare I say, it is only the beginning.....the only dilemma in me is, I dunno either it is the beginning of the end, or the end of the beginning !!! Whichever it is, it is a lose-lose situation for all of us.

Sometimes I wonder how would Bhimsen Thapa or Amar Singh Thapa, and so many other brave heroes of our nation would handle the current situation....Maoist's opportunistic behavior, Corrupt politicians, etc...etc.....Just wondering !!!

Clean people always come clean. It is a fact of life.

Just become someone is charged doesnt mean he/she is already guilty. I dont understand why people are so jealous and hateful towards these innocent people.

2. बिशेस् अदालत ठुलो कि अख्तियार ?
3. Does this give a way candidacy for the forthcoming elections?

You probably are in minority who says/thinks that Joshi/Khadka are not corrupt....Hell, there are hardly non-corrupt politicians any in Nepal....Its just a matter of who is more corrupt...Otherwise, why would these politicians fight for particular ministry or department?? For example, MInistry of Finance, Ministry of Agriculture, Ministry of Land Reforms, Ministry of Water Resources, Ministry of Defense are the most sought Ministries by these Politicians....Glad you asked why....Coz...they have the most potential of foreign aids, and more opportunities of............., you guessed it...Corruption ! Tell me why they don't fight for Ministry of Local Development, Ministry of Women and Welfare, Ministry of Science and Technology, Ministry of Culture and Tourism??? Why??

This was a criminal case and ,and in any criminal case the burden of proof lies on procecution, not the defendent. If the procecution does not have proof to prove their case without a resonable doubt then the case will be thrown out of court like it happened in this case.


People can make all sorts of specutalions about how they made money or why they are after particular ministry. After all , all speculations sit on very shakey ground.

These politicians are merely victims of political attacks which have no concrete basis nor do they have any substancal evidence that can stand in a court of law.

I guess all the foreign aid that Nepal receives is into all sorts of development projects then......I wonder where we rank on the poverty scale in the world....Or maybe, maybe...its just happens that we the people are misguided, misinformed about this whole corruption issue.....MAYBE !

Khaobadi....nice one.(about burden of proof)..but that is the US law....I wonder if Nepal's law follows the same....Oh well....Goodnight now !

Do you mean these politicians should be convicted without being proven guilty in court of law just like it happens in dictatorship regime ?

Do you mean you do not believe in fair justice system ? If you dont believe in fair justice system then what is point of demanding or having democracy.

Fair justice system is one of the basic pillars of democracy.
