 TPS EAD auto extended to June 2025 or just TPS?

Kinda Urgent!

Cannot find source (e.g., federal registrar) that says EAD auto extended to 2025 (which was my assumption). Apparently, its just TPS (which I have applied and is still pending). I am being asked to furnish proof of EAD extension which I cannot find. Call for help to immigration gurus.

Auto extended bhako haina Apunge. Tyo application pending bhainjel chai 540 din samma kam garna paune bhanya ho. Tuo pani decision aayera yedi deny bhayo bhane turuntai invalid huncha.

Babu Ho!

First you MUST apply new EAD, once you applied you'll get a receipt I-797

Once you get your receipt, give your old EAD card, NEW EAD receipt, TPS receipt, to your HR

HR they use USCIS i-9 central and they use

Employment Authorization Document ( EAD) Automatic Extension Calculator

Does your eligible employee's Form I-797C, Notice of Action, have a 'Received Date' on or after 05/04/2022?

Appreciate it Sexy-in-Sari and Shree Ram. @Sexy-in-Sari, what if one doesn't have physical EAD card with expiry date of June 2024 (but instead has on with expiry date of 2019) and has been using federal registrar notice to extend automatically without new EAD. Then the language seems tricky and could be interpreted as the extension of upto 540 days applies from what is printed in the card (I.e., 2019)?

@apunge, Your job is to give to HR. Not too much thinking.

A Nepali guy who has EAD card expiration date June 24, 2018, got receipt online, printed out and give it to HR, and he is good to go till Dec 2025. And he works for District of Columbia Government.

And you are twisting and turning saying language is this and that..wayat, too much talk.

@sexy-in-sari, I wish it was just my thinking. This is more or less accurate exchange with dedicated HR i-9 team in one of the FAANGs who have apparently consulted with their own lawyers.

This is what i sent my HR team
Receipt notice of I797 for EAD application which states i am eligible for automatic extension. And provided the link where USCIS announced automatic extentsion of EAD application to 540 days and also sent an expired copy of my ead which has the category A12 and explained that I am on TPS-Nepal and the validity is till June 24, 2025.

HR took 2-3 days to verify and emailed me they have updated my work permit to June 24, 2025.

@nash24, that makes total sense to me. Khai k dherai Batho bhayo bhane... jasto chha these know-it-all dedicated i-9 team/lawyers in the company.

Apune tyo HR le tyo proof deny garna paudaina. Kam bata nikalchu bhanyo bhane equal opprtunity ki k hotline huncha tya call gare huncha. Testo numbers haru sabai employee le access garna milne thau ma display garera rakhya huncha. Hamro ma chai break room ma cha. Call garera complain hande huncha tyo EAD prrof mandainau bhanyo bhane.

Apparently USCIS says one needs a new EAD card this time around and the expired EAD card with auto extension will not work with Nepal TPS according to the company lawyers who consulted with USCIS on this. Reviving this thread. Has anyone else been denied ?

Apunge, have you applied for TPS extension with application for new work permit? If you haven’t then there is no auto extension. If you have applied and you have a receipt notice and the case is pending, then you can work up to 540 days while the application is pending.

@ShreeRaam, I have. TPS extension last year, EAD last month. This is with the receipt notices of both.

Then provide the receipt notice and old EAD card. It’s clearly written in the receipt notice that you can work certain number of days when your application is pending.

Old physical EAD expired on 2019. They say (and apparently USCIS does too) 540 days extension can only be done to what's printed on the card not from federal registrar extension.

USCIS le testo kehi bhandaina. Maile Tehi nai dekhara I-9 verification garya ho. Provide all the documents that your EAD is valid till June 30 2024 according to FRN and you have applied for renewal this time and it’s pending. Tyo mannai parcha. Natra discrimination bhanera case hande huncha lol

They cannot do that! If you have applied to TPS EAD then the receipt notice itself says the following: Automatic Employment Authorization Document (EAD) Extension - This notice, by itself, does not grant any immigration status or benefit, nor is it evidence that this case is still pending. However, if you are eligible, you may to use this notice in conjunction with your facially expired Form I-766, Employment Authorization Document (EAD), as proof of an automatic extension of employment authorization and/or EAD, as applicable. You are eligible for an automatic extension of your employment authorization and/or EAD if: • You have timely filed to renew your current employment authorization and/or EAD; • Your EAD renewal request is under a category that is eligible for an automatic extension (see uscis.gov/eadautoextend for a list of eligible categories); • The category on your current EAD matches the "Class Requested" listed on this notice (if you are a TPS beneficiary or applicant, your EAD and this notice must contain either the A12 or C19 class, but they do not need to match each other); and • Your EAD renewal application is still pending with USCIS when your current EAD expires. If eligible, you may present this notice to an employer with your expired EAD (and Form I-94, Arrival/Departure Record, if applicable) for employment eligibility verification (Form I-9) purposes. If eligible, your automatic extension is for up to 540 days from the expiration date printed on the front of your EAD. If we deny your EAD renewal application, the automatic extension immediately ends, and you can no longer present this notice to your employer for Form I-9 purposes. If your EAD is also your Advance Parole document, the automatic extension does not apply to advance parole. If you are applying to renew A17, A18, and C26 employment authorization and you are relying upon the automatic extension to demonstrate your employment authorization during the automatic extension period, you must show this receipt notice, an unexpired I-94 showing valid E, L-2, or H-4 status, and a facially expired A17, A18, or C26 EAD that matches this receipt notice. Your EAD automatic extension terminates the earliest of: the end date on your I-94, the date we adjudicate this application, or 540 days after the expiration date on your EAD. For more information, please see our website at uscis.gov/eadautoextend.

Mr apung is correct.
These are the messages you'll receive from HR. (Have seen few)

"It appears that there is no update for Nepal TPS. There hasn’t been an update yet regarding additional auto-extension beyond 6/30/2024. Hoping that info comes out soon!"

"Thank you for the documents. The auto extension for renewal will not extend your card that expired in 2019/2020/2021."

'You are authorized to work until 6/30/2024. You will need to provide updated documentation by 6/30/2024 to continue to work if the Government does not extend the TPS date."

Hopefully, USCIS will grant another 6 to 12 months auto-extension FRN within the upcoming weeks. Last time they did it for Venezuela but 3 days(due to weekend) after the expiration day, many Venezuelans were auto-terminated. This delay not only impacts Nepal but also has repercussions on other nations such as El Salvador, Haiti, and Honduras. While President Biden may not prioritize Nepal, he shows concern for these countries. Let us remain optimistic and hope for positive outcomes.
