Dear readers, I am in F1 status. For the last two years, I worked and I have accepted cheque in many occasions. Is there going to be any problem(either with INS or IRS)? If it is going to be a problem, can I fix it now? Thanking you in advance.

You are in serious trouble dude both from INS and IRS so I will suggest you to return Nepal as soon as possible.

No, you are not in trouble. IRS doesn't care about your immigration status. If you have a W2 or 1099, you can even file a yearly income tax. Because of Kaput like "deshbhaktanepali", our country is getting behind.

been here for 10 years and came in f1. i worked in cash check and credit card and what not..don't worry at all- u r all fine. be careful u don't discuss that with people u don't know.

well, let me tell u something it is not bad thing and u are not in trouble in a short run like somebody earlier said that u could even file ur tas return which u can. but, talking about long run, if u are to apply a green card through h1 which will take almost 3-5 years upon ur change of status to h1 it will really difficult to get green card. ins wont do anything if u have worked less than 9 months on cheque while being on f1 status but if it is more than that u can work as long as us company gives u job but once u are ready to apply for ur green card problem starts there. i don't know how long u've been working on cheque but try not to work for more than 9 months if possible. because we all have problem being student and i know sometime u have to do whatever uhave to do to live here.

neptexkancha, while Most of the things that you implied in your post seem to be true and legitimate, one point that you made is totally nonsense! "ins wont do anything if u have worked less than 9 months on cheque while being on f1 status" What about the students with working permits?! I mean the F1 Visa holders with working permits?

If you have worked in cheque having work permit from your school, it is not a problem. You are allowed to work off-campus, 20 hours a week while in F1 and 40 hours a week while you are in Summer vacation. If you go to Nepal, and come back in F1, all your problem with irs/ins would automatically solved. Or INS will forgive you and count your days from your earliest entry in US. I am not sure how someone can work on Credit-Card. Under section 245(k) you are protected if you work without INS authorization for less than six months. 180 days rule gets applied here. I think someone mentioned 9 months which is not true. I request you guys not to thow dirt on each other. If you are not sure about the rules, please stay off topic to address the current situation. This will help you as well in long run. Thanks guys.

mote , what you are smoking man? if you didn't give s.sn then how is your earning reported to the irs? if i write you a check for @20 to buy your old pairs of chuck taylors, would Ins know??? jesus, quit freakingout man.. most of us have been struggling for years in this country as students, h1s and uncertainities and then gc and unsecurities... watch Michale moorer's SICKO on movie6.net and realize Nepal is not bad at all if you do have to go back.. it's not like you're getting thrown back to hell... tell me which one is hell for you; a place where you have to worry each and every moment of you rlife about rent, food, payments, even legal status....?? where life has no security? or the country where people love you,they don't look down on you for looking dark or having an accent, where no matter how harsh, you don't have to work like dogs... which one is the best option for you>>>?? So , although it is very wise to live in the USA if you can make it, it' snot a total diasaster if you have to go back... I wonder how many people from Nepal,where per capita income is less than 300 can offorrd to go to schools in usa at least a 7000 dollars a semester and living expenses totaling somewhere close to the tution....if you don't have an option , do what you gotta do... quit feeling guilty abou tit.... if you're an honest perosn and if you think honesty is the best policy then just go back to Nepal..leave a thank you note at the departure .....

Kalopani, We all come to America with a dream. That doesn't mean that everyone makes it. Similarly, not everyone breaks in Nepal. I have had thoughts several times to go back Nepal. But it scares me to death when I see myself being the victim of widespead corruption, cronyism and political instability. Don't misunderstand me of being critical of Nepal but it gives me enough reason to resent the direction we took in the past and the direction we are heading to. I still love Nepal and I would still opt to settle in Nepal sometime in the future. Jay Nepal.
