hi guys; My consultancy company(ofcourse indian :) ) is ok with sponsoring eb2. What they are telling is for advertisement/screening it takes around 2 month , then they will file for labour which takes around 2-3 month, then they can file I140 & I145(don't know how much time it will take). For entire case ie. for screening it takes around 1500 and remaining takes 3500 and ofcourse they won't penny(which doesn't suprise me at all!!) . So, my question is , is the infromatiion i am getting is it right and correct. I am bit new onto this so any nepali friends has gone through this process ,can you please split the time and money it takes for each step until we get gc. That will be bit helpful for me cause i can better understand this stuff and i can bargin them accordingly. ps. Do you guys think it is better to go through consultancy esp. indian i doubt cause i heard they delay sending the paper to uscis intentionally so that they can stretch time as much as possible such that consultant stay with them as long as possible.right...any of u guys working in decent company esp in j2ee environment who does sponsoring and they are good and fair..i am willing to transfer my visa there..so any help will be appreciated..u may send personnel email thx..

Pakandi, Price looks decent to me. I paid way more than you are getting. Yea, advertisiment will take about 2 months coz you have to post 2 ads on sunday papers with one months difference. Labor should not take that long sometime it takes longer too. Mine was done in 14 days so it varies from 2 weeks to 10-12 weeks. I-140 will take about at least 10 months according to data from USCIS currently they are processing Sept. 2006. but if you do premium processing it can be done in 2 weeks but it is also suspended now. for I-485 it not available now due to visa number. We can't predict anything on that ..I heard that we will something from USCIS by this coming Monday otherwise we have to wait till Oct 2007 which is good for you as you can finished other process before that. thanx san dai btw how much we have to pay for I-140 for normal process and premium process any idea?Also for I-485 as i heard they are increasing fee for it no. i understand I-1485 is for adjustment of status but what is I-140 though? after I-1485 what is the process are there any forms or other procedure to follow beyond I-1485 acceptance from ucis. Suppose after october 2007 ucis accepts I-485 forms then how long it takes to get I-485 to be accepted.I guess we don't have premium for I-485 no, like we used to have for I-140.any idea? my other question is i haven't graduated yet but i have all the credit fulfilled and my uni can sent/give transcript for my masters,infact i will graduate on jan,2008.so, can i still apply for eb2(i heard they require master degree,isn't it?). thx..

Pakandi, yes you are taking a chance when going thru Deshi consultancy. I have heard that the ordeal could be mind-numbing as well as traumatic. You can file 485 on your own when you get there. No monies involved for lawyers and crap except for 1000 bucks or so filing fees under the new fee regulation. you need one support letter from the employee. I-140 can be filed for 300 odd bucks under new fee. Correct me on this. you need one letter from the employee and financial papers. Labor is electronic filing. The cost runs only for Ads and some other nominal fees. Good Luck!

I-140 you can not file on your own. I-140 MUST be filed by your employer. I-485 you can file on your own. There is no premium processing for I-485 but for I-140 it cost $1000 extra for PP. duration for approval for I-485 is not predictable now it may from 6 months to 6 years all depends upon visa bulletin. I have my labor certification filed almost a month before. After labor certification, how long a person can wait maximum to file I-140 and I-485. If my labor certification is finalized by end of July , I am afraid I can not file I-485 until october which is more than 2 months away.

hi san dai and mansing thx for the response..ok so once labour is cleared..then we file I-140 and I-1485 together or it is other way around iie. employer file I-140 and once ucis accept this then we can file I-485 individually. Besides i heard in the forum that we need birth certificate, finger print etc..may be i am wrong if it is not related.Can somebody clear this plz.Thank..

Hi Friends, I too have a question on GC processing, please let me know you thgoughts. I am on OPT now and it expires on May 15,2008. I didn't get the H1B for this Year. One of the Indian Consulting Co. told me that he will file for the Labor Certificate and Green Card if I join them, but I have to pay the Lawyer fees which he says is $3,500, not including the Ads because he says he has the current Ads and I can use them. I do not know anything about this and therefore I am here to get help. Shall I join this Consulting Co. and ask him to process for my LC and GC? Will I be able to get the LC before my OPT expires? Once I get the LC, how long can I work here legally before I file the I-140 and I-485 forms? Thank you!!!

I dont think that you can have your case settled before your OPT expires. LC takes 45 days to 60 days. EB02 process takes 1 year. On top of that there is no certain of I-485 at this time.

Yes, I-140 is employer centric. Also the labor, ETA filing only the employer has access to. There seems to be lot of drama in terms of buying time and making consultants come down on their knees based on H1b and GC related immigration procedure... I recommend my fella Nepali frens to be wise and have a vision about what you expect and what is their in reality. Best! -B

yes bricolage; you are right of this body shop consultancy. Well they even told me that once approved i have to stay 2 yrs for them. I think i know how to deal with this guys :) . My h1 is yet to be approved ie. if approved then i will have my h1 on october but as i am still working i thought of apply gc right away such that i can gain atlest 3 month thats what was my concern.Anyway thanx guys for the response.I appreciate this.
