Hi ppl,

I am in some doubt plz help me to clearify it. My gf is in US in b2 visa (tourist visa) is it any way to make her f1 or f2 or any other visa so that she can stay with me.

if she marry me will she automatically become f2 or she have to go back to nepal and apply.

which is easier to do change her to f1 any other visa

if none of above is possible ... is it possible for her to extend her b2 visa
if yes how ?


any help is highly appreciated....

how long has she been in the usa? looks like she'll be the one who can help you get a stuatus dude.. freakin' Bush is awarding all the illegals while you legals sit back and see them prosper for breaking the laws.... welcome to the jungle.. but congratulations.. sit back and relax, and put on the show of immi... soon you'll know what's it gonna be... as per current's rule.. no your F1 visa status don't do shyttttt for her... even you'll be deported on the grounds of producing ankor babies...
so patience is the key for you homie

OPTIONS:

1. Marry. Register in City Office. Get the Certificate. Apply for Change of Status from B-2 to F-2. File I-539 for $200 from www.uscis.gov.
RESULT: F-2 Status concurrent to your F-1status

2. Apply for Admission in any college, be it language, Kaplan, Community. Get an I-20. Apply for Change of Status from B-2 to F-1. File I-539 for $200 from www.uscis.gov
RESULT: F-1 Status concurrent to the I-20 period

3. File for a visa Extension. Extension of B-2 Visa. File I-539 for $200 from www.uscis.gov Ask for 6 months form the date of expiry. Show reasons such as tourism, relatives marriage/engagement, health check up, business needs if she owns/runs business in Nepal
RESULT: Extension of B-2 visa for another 6 months.

4. File for Asylum, if she qualifies.
RESULT: Approval-------------Green Card/Pending-------Work Permit/Denial-Indefinite temporary status until she leaves OR Deportation i.e. Back to Nepal

Santosh,
You seems to have good knowledge on immigrations issues. My uncle got denied on
Asylum and they have called him in court. What is the probability that he would get
approved asylum in court? If he doesn't make it even in court, will they deport him anyway or he can just ignore the deportation letter.

you have 4 option to choose as santosh advice,
Option 1 : Change her to F2, yea this is a good option but needs to show financial support for her to change to F2. if you are graduate student with assistantship than no problem. Also depends how long you have been here like , if you are undergrad student , came to US last semester with no scholarship that there will be a problem. But there is more chance that other option. It also depends how your gf came here in B2 visa ? what was the purpose of visit, ( is it to see her bf? obviously not), if someone sponsor her trip than letter from that person make your case more strong because if onyone came to US with one purpose and did different things than mention in visa application than it reduce the chance of change of status.

Option2: Change to F1 status. This is not that easy as people think.She need all documents from previous school, sponsor letter, bank documents ( INS requires bank document in this case) test like TOEFL , GRE and you need to apply to college 6/7 months before school starts. After school accepts than you can file change of status to F1. There will be no cannce of acceptance unless she has "Prospective Student" stamp on her visa. INS will not approve without "Prospective Student" stamp they made this rule I think 2 yrs ago. Otherwise she can get her I-20 and go to canada for F-1 visa, usually they say go to home country. Don't go with this option, unless she wants to go to nepal to get F1 visa, (this will increase her chance of getting visa coz she will be just returned form US without overstaying and its easy to believe to councellor that she will return to nepal after study)


Option 3 : File visa extension. This is not a good option this is just to extend the stay by 6 month and eventually you have to go with other option after 6 months. It will also make your case weak than before . So , DO NOT go with this option.

Option4: File asylum. This was"Brahama Astra" for nepali to stay in US before showing maoist problem. But maoist are in government now and this will not work. These days INS is rejecting asylum a lot.

On conclusion, I think go with option 1 or option 2 but if you go with option 2 than you MUST have to go to canda or Nepal. So, easy would be option 1. Get married.
Don't forget to call me on wedding party... :-)

I would go for option 1 as every one told me...
can anyone plz tell me briefly about legal steps that i need to take for option 1.
it will be highly appreciated..

i am undergraduate student been here for nearly 3 yrs and am working in citigroup.
my gf came from singapore and have associates in hotel management.

So, are you doing intern in Citigroups than there won't be any problem.get married, and apply for F2 status your school's iinternational office will do for you.

I came to US before 1 week holding on B1/B2 visa for 3 months.I want to stay without status.I have passed BA in arts and certificate in ophthalmology(in eye subject).
Now I am stayinhg at Savannah,Georgia.
Please kindly suggest me your valluable suggestion, will be highly appriciated.

but if the B1/B2 holder has "prospective student" stamp on his/her visa..won't the immigration officer here in USA nag a lot upon arrival?

Usually they ask why did u come to USA and what would be the appropriate answer?

I am asking this for a fren of mine who has B1/B2 visa and wants to come here and try for change of status to f1.
