Hi, I got couple of job offers and when I told them about my OPT and H1 sponsorship before accepting the jobs, they gave me various reasons and said they wouldn't be able to sponsor me. I don't know whether I should take the job first and tell them later or ask for the sponsorship up front. Is anybody facing or have faced such problems? I would really appreciate if you could suggest or share your experience. What if my sister (u.s citizen) sponsors me? How long would it take? Would sponsoring from a sister and from a job ( if in case, employer sponsors for H1 visa) cause any problems? Thank you everybody in advance.

You should have to told you have a work permit now ( OPT) and you have to renew your work permit (H1B) which is few paperworks my lawyer will do all these works you just have to sign some paperworks which includes my salary and job description and some information about company. You should not use word like OPT and sponsorship like that. If you use these words than they may be scared and will not do H1b. I am working on H1B now and I have been through all these situation. Well, if you don't tell them , then u have to provide them the work authorization paperwork most likely green card , ssn ...Those HR ppl are very conservative and are not willing to take any risk at all ...I did the samething with one offer saying that I have work authorizatioin but I did not tell them for how long. After I filled out all the application, they asked for my legal paperwork and they told me that I have to provide them work authorization beyond one year. So I ended up loosing the that job. From that time on, I only applied to the companies who do H1Bs and I still got 2 offers.. so now I don't have a problem..If you got 2-3 offers now , I'm pretty sure u r capable of getting other offers fom company that do h1b...Good luck.. After the first decline, I made up my mind saying that I would not waste all my time with those lousy companies who don't do H1b and went after the one who does.... I don't know man it seems as if everybody has different policy regarding immigration and legal stuffs..If something worked for me doesnot necessarily mean that it will work for you unless it is completley straightforward.. Try the way SAAN DAI said, if it works, it works if not then try smth. else.. My sis is also US citizen and getting green card from that way takes forever man..I tried dat too and I will tell u this, it is not the best way for ur situation cauz of the time factor...

Thank you San-dai and Anthony15. It was very informative. If anybody had such condition, how did you get through it? Sharing your experience, views, and concerns would be highly appreciated. worst case scenario : If I don't get sponsored by the employer within one year, I am thinking of going to grad school. Do you think it is possible for me to get sponsored through my sister within three year so that I do not have to go through this crap again after finishing grad school. Anybody here know about any good lawyer in DC/Baltimore area? Thanks in advance

dark_80, maybe a consultany which does H1Bs can be an option for you. i've heard of consultancies operated by nepalis too. have you given this a thought?

GC through sister will take more longer. It takes about 5 yrs to get GC through employer on EB3. For worst case go to grad school, you can even do you GC on EB2 if you have masters and employer is willing to do GC it takes only about 1 yr so doing Master is not a bad idea for ur future. Medwestdude, Is consultancy same as agency? I don't have know much regarding this matter. I did speak with some people from sulekha some time back, but it didn't go anywhere. Could you give more information about nepali consultancy services? San-dai I have a business background. Thanks

dark_80, i don't personally know any nepali H1b placement agencies. but i heard there are some in dallas and elsewhere. of course i am not implying the fact that they might be better than the desi ones you saw in sulekha but i see these agencies as a savior when all else fails. i know of many people who are getting sponsored for green card etc. but there is a trade off. you are paid very little while on H1b and contracting and you might have to pay extra for green card filing. the benefit is that the green card is in process even if the contracting ends and you are looking for other contracts. i'd advise to only go for the above mentioned route if all else fails. the best thing to do is to get a full time position with a company and have them sponsor H1b and green card. but it might be tough in today's times. unless you are in IT, it's pretty tough to get sponsorship. even the agencies/consultants might not be willing to sponsor you if you're not into IT because they can't place business people as fast as IT people. what exactly is your stream in business?
