hello all.. i have a quick immigration question. i have been living in USA and studying on f1 visa. recently i went back to nepal and came back and had to get a new f1 visa. anyway now im back in USA and want to marry my Girlfriend who is US citizen. can that be considered visa fraud ?? if so should i just wait for 3 months ? should i tell INS that i only met my GF this year???? (actually ihave known her 3 years) help out lato boy if u can. thanks in advance, Lato

Just tellthem the truth. You will be all set. You have papers to prove it. Althouh sometimes they mightask you to show them other proofs like photographso even a new bon baby. So,you can start on making a baby now and wait for at least 9 months to marry her. Goodluck, PC

Hey Dude, Don't worry about your immigiration status right now as long as you are legal in this country and you haven't violated any laws you should be fine. I got married last year after dating for less than a year and I have my GC in less than 3 months I am fine and everything went smooth without paying an attorney any money. But i do really suggest that you think it over, marriage is nothing to be played with. I know a lot of immigrants come here and try to settle down or at least make their way to the citizenship through marriage and an immigiration officer knows that too. He/ she deals with those people in larger number everyday but as long as you think you will be with the woman you married till one of yours last breathe i say go for it and don't worry about all other stuff. Regarding immigiration papers you must have a solid proofs that you are guniune and your marriage is legitimate. Remember to provide those evidences it could be as little as a joint account, utilitiy bills and deeds or joint property, insurance policies or benificiafries don't worry about making babies right away you don't have to. Also do not rush into getting your GC as soon as you got married it will only raise a red flag so take your time, get married go for a honeymoon and start thinking about immigiration papers in 5-6 months. Ifyou are guniune and truley willing to commit for life with the woman that you married, I can hep you with the papers without any cost.

Well this is a crazy issue that has been confusing me in a different way. I came across this cool girl , of course US Citi,,while we were still in school, became best frens,,but after school was over we had to move to different places to get ahead with our jobs and stuffs..We want to get married, but I being in H1 cannot leave my job and move to her city, while she cannot leave her job (it took a lot of effort to get it and I dont want her to give it up for anything). I dont know how things work in this kind of situation,,I am not really worried about getting GC and all,,but it just seems like searching for the end of a circle..without GC I cannot find a job around her place,,and I cannot leave my current job because of crazy H1B issue, for which I have to be employed at any case..Dont know how they are going to take it even if we get married at this point,,her parents are more than happy for us to get married,,,but well ,,i wish it were like in Nepal,,most of the big jobs located all in one city,.,I am waiting for my employer to sponsor my GC...

There is nothing to worry about in this case. If you really want to marry, if the marriage is not fake then there is not going to be any problem. You will get your GC in 6 month thats the maximum period. Once you file the papers you will have 180 days grace period that means if you dont go to school or leave your Job(H1) its ok. Just make sure that you have enough evidence to prove your relation. Like picture, joint property, insurance ete. Other thing do not lie when you go for interview just answer whatever the right things. If you need any help you can write me an email i will be glad to help you with.
