My wife came to the states as F2-dependent, applied for TPS EAD and worked using it. During this time we have a baby and now she left her job. Can she go back to F2 itself if she doesnot apply for TPS extension? Does she need go back to Nepal and reapply for F2 visa? I also have TPS (no TPS EAD) and have maintained F1 status throughout the process and I am graduating this December.

If you are maintaining F-1 she was still in F-2 along with TPS. Getting TPS and working with TPS EAD will not make out of status. We are doing the same. I am in F-1 my wife is in F-2. I am maintaining F-1 and we both are working using TPS EAD. But recently, she applied F-2 to F1 and it got approved. Contact with your DSO.

Thank you NepaliNajar. Did you consult with lawyers or is it just your opinion? When I check other discussion forums they have contrasting views on this topic. I am really confused with this since there were different views on earlier posts in sajha. Do you recommend renewing tps EAD?

We consulated with DSO and Lawyer. We are working on TPS EAD and we are both good with our status. In summary, there is not relation between TPS and other non immigrant status. TPS is just a benefit on top of other non immigrant status. But, if someone does not have non immigrant status, TPS protects them.
