what is the process of adjusting the status if I have an approved I140 and 485, and the spouse is back home how long would it take for her to apply and get back to the states would it be better if we applied for both when she was here ? please advise

Sbp726 Man why would you answer a question with a question ? that ain't right man. As i was saying ,she is back home , and if i applied by myself, as she cant do that , what, if any, are the repercussions of her applying from Nepal ?. what is the timeline for her to actually comeback if she does that. thanks,

NepaliLawyer, Thanks for the reply. Would you recommend that I go ahead with the application without asking my wife and children to be back here, and then ask them to apply through the consulate if and when I get my status changed ? or it is better if she is back here and we complete the process together after she is back ? thanks, Sajhahelpuser

If your spouse is already in us, she/he may apply for AOS based on following to join. IF outside US, LPRs need to inform a US consulate of their lawful status in order for their family members to apply for immigrant visa. In both following to join cases spouses do not have to wait for visa number so the end result is the same but where the spouse resides affects what procedures he or she needs to follow. If there is confusion, contact Rijal Law Firm to simplify the process.
