On Tuesday, June 24, a federal judge in Maryland seemed unsure about whether he has the legal power to review the Trump administration’s decision to end Temporary Protected Status (TPS) for Afghan and Cameroonian nationals.

The government argued that the court has no authority to review the decision.

Immigrant rights advocates argued the decision was unfair and did not follow proper legal procedures, so the court should step in.

The judge has not yet decided which side is right.

The judge’s hesitation to step in might be a bad sign for TPS holders from any country. It means their protections could end, and no court may be able to stop it.

The circumstances suggest the judge may be facing undue influence from the Drumphy Administration, which would represent a flagrant violation of judicial independence. If this is the case, the appropriate course of action would be for the judge to disclose the nature of this pressure and recuse himself from the proceedings.
